1. LEGAL CAPACITY OF THE USER

By accepting these Terms, you represent and warrant that:

  • You are at least the age of majority in your country of residence, or you have the legal authorization of your legal representative to enter into contracts.

  • You have the legal capacity to enter into binding contracts under applicable law.

2. TERRITORIAL SCOPE AND CUSTOMS

Our products are available for sale and shipment worldwide, except in countries or regions where legal prohibitions or commercial restrictions apply.

The Customer is responsible for:

  • Verifying that the importation of the products is permitted in their country.

  • Paying any applicable taxes, customs duties, import fees, or additional charges.

  • Providing the information required for customs clearance at the destination.

HeroPortal shall not be liable for delays, returns, or seizures resulting from customs regulations or local authorities.

3. USE OF THE WEBSITE AND SERVICES

The use of the website or products for unlawful, fraudulent, or rights-infringing purposes is strictly prohibited. In particular, the Customer agrees not to:

  • Upload or transmit viruses, malware, or any harmful code.

  • Reproduce, copy, or commercially exploit any website content without express authorization.

  • Use the website for defamatory, discriminatory, or public order–violating purposes.

Failure to comply may result in account suspension or termination and the initiation of legal action.

4. PRODUCTS, AVAILABILITY, AND PRICES

Product descriptions, images, and specifications are for illustrative purposes only and may vary slightly from the final product.

All prices are displayed in the applicable currency and do not include taxes, customs duties, or import charges applicable outside Spain or the European Union.

We reserve the right to modify prices, withdraw products, or cancel orders in the event of an obvious error in stock availability, description, or pricing.

5. ORDERS, PAYMENTS, AND BILLING

The Customer agrees to provide accurate and up-to-date information when placing an order.

We reserve the right to refuse or cancel any order in cases of suspected fraud, unauthorized resale, or misuse of the Services.

Payments are processed through secure payment gateways. We do not store complete credit or debit card details.

6. SHIPPING AND DELIVERY TIMES

Delivery times are estimates only and may vary depending on destination, product availability, and customs procedures.

HeroPortal shall not be liable for delays caused by circumstances beyond its control, including strikes, government restrictions, pandemics, or logistical disruptions.

The risk of loss or damage to the products transfers to the Customer upon delivery to the carrier.

7. RETURNS AND RIGHT OF WITHDRAWAL

The Customer may exercise the right of withdrawal within 14 calendar days from receipt of the order, except for personalized products or intimate items that cannot be returned for hygiene reasons.

Return shipping costs shall be borne by the Customer, except in cases of defective products or errors attributable to HeroPortal.

8. LIABILITY AND WARRANTIES

Products are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation of the website.

Our liability to the Customer is limited, in all cases, to the amount actually paid for the corresponding order.

Under no circumstances shall HeroPortal be liable for indirect damages, loss of profits, loss of data, business opportunities, or damages arising from the use or inability to use the website or products.

9. INTELLECTUAL PROPERTY

All content on this website (trademarks, logos, designs, texts, images, and software) is the property of HeroPortal or its licensors and is protected by international intellectual property laws. Any reproduction or use without express authorization is prohibited.

10. APPLICABLE LAW AND DISPUTE RESOLUTION

These Terms shall be governed by Spanish law, unless mandatory consumer protection laws of the Customer’s country provide otherwise.

Any dispute shall be submitted to the courts of Barcelona, Spain, unless mandatory consumer regulations require a different jurisdiction.

For international customers, and where legally permitted, disputes shall be resolved by arbitration administered by the International Chamber of Commerce (ICC), conducted in Spanish, with its seat in Paris, France.
